Civil Wrongs
‘A civil wrong is a breach of legal duty which affects the interests of an individual to a degree which the law regards as sufficient to allow that individual to complain on his or her own account rather than as a representative of society as whole’ (Clerk and Lindsell on Torts 22nd Edition).
Interests protected by the law of torts are the following:
- Personal Interests such as personal liberty, physical security from injury, psychiatric harm and distress
- Property Interests such as possession, physical damage to property and interests of enjoyment of property
- Economic Interests such as pure economic loss and unfair competition
- Loss of Chance; and
- Public Interests such as public rights, due process and constitutional rights
